Terms of service

Last updated October 19, 2026

Botensten Mail is a newsletter service run by Charles Botensten ("we"). By creating an account you agree to these terms. If you don't agree, don't use the service.

Your account

You need a working email address to sign in. You're responsible for what happens in your account, including through API keys and AI agents you connect, so keep them private and revoke the ones you no longer use.

You must be at least 16 and able to enter a contract. One person or organization per account.

Plans and billing

Plans are billed in advance, monthly or yearly, through Stripe. A yearly plan costs 11 months. Prices are in US dollars and may not include sales tax.

Each plan includes a number of emails a month. When they're used up, new sends wait until you upgrade or the next month starts; we never charge overage without asking.

We may change prices for future billing periods. We'll email you at least 30 days before a change affects your plan.

Cancellations and refunds

You can cancel anytime from the billing page. Your plan keeps working until the end of the period you paid for, then stops renewing. We don't refund partial periods.

If we close your account without you breaking these terms, we refund the unused part of your plan.

What you send

You may only email people who agreed to hear from you, and every email must follow the Acceptable use policy and the laws that apply to you and your readers, including CAN-SPAM, CASL and the GDPR.

We pause campaigns automatically when bounces or spam complaints pass safe levels, and we may suspend or close accounts that send spam, harm deliverability for other customers, or break these terms.

Your content and your list

Your newsletters, subscribers and data stay yours. You give us permission to store, process and send them only to run the service for you. You can export your contacts at any time.

When you delete your account, we delete your data after a short grace period in which you can restore it, except what we must keep by law, such as invoices.

Availability

We work to keep the service running and your emails delivered, but we can't guarantee uninterrupted service or inbox placement: mailbox providers decide where an email lands.

Liability

The service is provided as is. To the extent the law allows, we aren't liable for indirect or consequential damages, and our total liability is limited to what you paid us in the 12 months before the claim.

Open source

Botensten Mail is built on MailCheap, open-source software under the GNU AGPL 3.0. These terms cover the hosted service; the source code comes with its own license, and the footer links to this server's source.

Changes and contact

We'll email you before material changes to these terms take effect. Questions go to hello@botensten.com.
